Can a collection company remove a collection account from your credit report if you offer a settlement?

Posted by admin on February 28th, 2010 and filed under credit collection | 4 Comments »

I have bad credit due to collections on my credit reports is there a way to have the collection company to remove them from my credit reports how about if you offer 100% of the total debt will they remove them?

Absolutely. Make sure you get it in writing, though! Collection agents are slime.

I would offer to pay less than 100%. Negotiate. They may be willing to take less to remove them.

There are many other legal tactics I would try first before paying, to be honest:

Collection agencies keep calling me looking for someone else – how can I get them to stop?

Posted by admin on February 28th, 2010 and filed under collection agencies | 9 Comments »

I keep getting phone calls from collection agencies asking for a woman that I don’t know and who has never lived at my address. When I looked her up on the internet, she has an address and a phone number (that’s NOTHING close to mine, BTW). I’ve told the SAME company they have the wrong number and they still keep calling – it’s starting to feel like harrassment. When the agency called last night I told them they had the wrong number and that they could look her up. They said that if I gave them her number then they’d stop calling me! Wait, it gets better . . . I said wait a minute, let me fire up my computer to look her up and give you the number and the collection agency lady said, "Madam, I don’t have that kind of time to wait on the phone!" I have the woman’s number ready for when they call again, but what if they keep calling? What do I do?

Call the company, ask for a supervisor and explain the situation. Ask for the supervisors name and tell him/her that you are documenting the conversation, time and date and let them know you are for the final time, asking them to not call you again as they have the wrong person. Tell them, if the calls continue, you will seek the advise of an attourney…

What is the statue of limitations on debt collection?

Posted by admin on February 28th, 2010 and filed under debt collection | 3 Comments »

I received a collection for debt from a credit card I don’t believe was even mine! The letter states they tried to collect in 1999 but I never responded. It’s been over seven years since this so-called attempt to collect and I’ve received numerous credit reports over the years and this account has never appeared. What are my rights and how should I handle this???

Read the link below. It discusses what the statute of limitation is, and what the length of time in your state is. Most states run 4-6 years, but some are more. So look at the link.

The very first thing you need to do is send the collection agency a "demand to validate". This is a demand that they send you proof that you have a legal obligation to pay this debt. They must send you copies of contracts, bills, receipts, and everything used to calculate what they claim you owe.

Include in this letter a statement that you do not believe this is your debt, and tell them you expect some proof. Also remind them that posting unvalidated reports to your credit history is a violation of the Fair Credit Reporting Act, and they can easily be sued in small claims court for $1000 if they try to do it.

Also include wording to the effect that they must cease and desist contacting you.

See the link below for a sample letter you can use.

If you have not checked it recently, get a copy of your credit report and verify that they have not posted anything on your history. You can get a free copy by going to http://www.annualcreditreport.com

Is it legal for a collection agency to call a persons neighbors and leave messages?

Posted by admin on February 28th, 2010 and filed under collection agency | 7 Comments »

I received a phone call from a collection agency in N.C. about my neighbor and they wanted me to leave a message for them on their front door. Apparently, their phone has been disconnected (how convenient). It seems they just ran the address and started calling neighbors. Isn’t this a an invasion of privacy or some other form of illegal business practice on the part of the collection agency? If so, which agency is it reportable to?

They have a right to contact you if they are looking for the debtor. They can not disclose any information about the debtor or his loan. They can’t even say that he owes them money.

You can tell them not to call again, but from my standpoint (Collector, and a nice one) these guys skip out from their bills any way they can. Especially now days with cell phones, no one has home phones and it is hard for us to get in touch with them. We were kind enough to lend them the money when they needed it, now they won’t pay up. It is theft. When I find someone (a family member, co-worker, friend, neighbor) who is willing to at least pass on a message, or give me a contact number, I want to kiss their feet for helping me. It is so frustrating tracking people down.

If they think that word is getting out that they owe money, maybe they will call and work on paying it off. That’s all we want, is for them to stay in touch with us. If they do, we don’t contact anyone else.

What happens after a creditor sends you to collections?

Posted by admin on February 28th, 2010 and filed under collections | 3 Comments »

It’s been seven months since I’ve paid anything on my Credit Card. They have sent me to collections and now I don’t know what to do. What will happen if I continue not to pay. My debt is about $11,000. Can I still call the original creditor and try to straighten things out?

well, the collection agency owns your debt now so the original creditor isn’t going to do you a lot of good. the best thing to do is start sending them money. even if it’s just a little bit. say you want to get on a payment plan. send them like $5 a month if that’s all you can do. good luck. if you don’t pay anything they can come and repossess your stuff.
